(1) In case of immediate death due to an accident in the course of official work of the chief justice or judge or in case of death after not recovering due to the same, his widow wife or widower husband shall be given a separate lifetime monthly family pension as follows and more thereon. The following gratuity will also be given. decoration: underline;">Patke Upadan
(a) Chief Justice Four hundred fifty rupees 10 thousand rupees (b) Judge Three One hundred and fifty rupees Eight thousand seven hundred rupees (2) For the purpose of giving lifetime monthly family pension and additional gratuity as per sub-section (1), the Chief Justice or the widowed wife or widower of a judge shall be recognized only in the following cases:-
p>(a) having been married to the chief justice or judge before his death,
(b) having cohabited with the chief justice or judge at the time of his death.
(3) ) If there is no widowed wife or if she has separated from her husband before his death or remarriage of the widowed wife bIf this is done, the child born from a widowed wife can be given a lump sum by the damasahi as specified in sub-section (1). It can also provide family status at a reasonable rate not exceeding one-third.
(4) The widow of a deceased chief judge or judge has no wife, widower or children, and the dependent mother, father or mother-in-law, father-in-law of such chief judge or judge. or if there is one of the two, for the sake of their livelihood, the Government of Nepal may grant family allowance at a reasonable rate not exceeding two-thirds of the amount of family allowance received by the widowed wife or widower husband for the period it sees fit. If there is no widow, widower, child or mother, father or mother-in-law, and if any of the dependent brothers or unmarried sisters of such chief judge or judge remain, for the purpose of their livelihood, for the period deemed necessary by the Government of Nepal, the number of family status that the widowed wife or widower husband will receive by Damasahi. A reasonable amount not exceeding two-thirds can be provided to the family.
